SMCpeople collects personal and proprietary information for the sole purpose of carrying out commercial operations. In collecting such information, SMCpeople is bound by and complies with the Privacy Act 1988 (Cth) (‘the Act’) and Privacy (Private Sector) Regulations 2001 (Cth), as amended.

Personal information means information or an opinion (including information or an opinion forming part of a database), whether true or not, and whether recorded in a material form or not, about an individual whose identity is apparent, or can be reasonably ascertained, from the information or opinion. 
The SMCpeople Privacy Policy (‘the Policy’) is prepared in accordance with the National Privacy Principles as set forward by Schedule 3 of the Act.

COLLECTION OF PERSONAL INFORMATION
This Policy relates to personal information collected by any means. SMCpeople will, when it is reasonable and practicable to do so, collect personal information directly from you.
In other circumstances, there may be occasions when SMCpeople will source personal information from an external third party, or publicly available source, for example, current or previous employers and colleagues, referees, credit rating agencies or law enforcement agencies. If SMCpeople does not have your prior consent, SMCpeople will, when reasonable and practicable to do so, seek to inform you your personal information has been collected from a third party.

USE OF PERSONAL INFORMATION
SMCpeople collects personal information for the sole purpose of carrying out commercial operations. In general, SMCpeople may use your personal information in a number of ways, including, but not limited to: 
assist you in finding or retaining work;
assist in your career performance or management;
analyse human resource and labour markets; or
develop tests and assessments in order to place you in appropriate roles.

Generally, the personal and sensitive information SMCpeople collects about you may include the information that you place in your job application or resume, for example, your name, address, telephone number, e-mail address, career history or details of other information relating to your career.

USE BY THIRD PARTIES
In accordance with modern business practices and to meet your specific needs, SMCpeople may disclose your personal information to certain third parties. Where your personal information is disclosed we will seek to ensure that the information is held, used or disclosed consistently with the National Privacy Principles or any other applicable privacy laws and codes.

KEEPING YOUR PERSONAL INFORMATION ACCURATE AND UP-TO-DATE
SMCpeople takes reasonable steps to ensure that the personal information we collect, use or disclose is accurate, up-to-date and complete.
In circumstances where you believe your personal information is inaccurate, please contact the Privacy Officer.
SMCpeople may also contact you from time to time to check the information is still correct.

PROTECTING YOUR PERSONAL INFORMATION
SMCpeople stores your personal information in different ways, including in paper and electronic form. SMCpeople considers the security of your personal information seriously and as such, takes reasonable steps to protect your personal information SMCpeople holds from misuse and loss and unauthorised access, modification or disclosure. The use of locks and security systems assist SMCpeople in protecting your personal information.
When no longer required, personal and sensitive information is destroyed or deleted in a secure manner.

YOUR PRIVACY ON THE INTERNET
SMCpeople takes care to ensure that the personal information you give us on our website is protected. By using SMCpeople’s website, you consent to the terms of the Policy. SMCpeople takes reasonable measures to protect your personal information, for example through the use of firewalls and data encryption, however users are advised that there are inherent risks in transmitting information across the internet.
When you access SMCpeople’s website, SMCpeople gathers information about users collectively. Such information includes the areas that users visit most frequently and the services users access the most. SMCpeople will only use such data anonymously and in the aggregate. By doing so, SMCpeople can optimise the services it provides to you.
SMCpeople may provide links to external websites on our website. Such websites are not subject to our privacy standards, policies and procedures.

GAINING ACCESS TO YOUR PERSONAL INFORMATION
You may be able to gain access to your personal information held by SMCpeople. This is subject to some exceptions allowed by law. Factors affecting a right to access include, but are not limited to:
access would pose a serious threat to the life or health of any individual;
access would have an unreasonable impact on the privacy of others;
a frivolous or vexatious request;
the information relates to a commercially sensitive decision making process;
access would be unlawful;
access would prejudice enforcement activities relating to criminal activities and other breaches of law, public revenue, a security function or negotiations with you;

denying access is required or authorised by or under law.
SMCpeople will give you reasons if should we deny access to your personal information.

USING GOVERNMENT IDENTIFIERS
Although in certain circumstances we are required to collect government identifiers such as your tax file number, we do not use or disclose this information other than when required or authorised by law or unless you have voluntarily consented to disclose this information to any third party.

DEALING WITH US ANONYMOUSLY
You can deal with us anonymously where it is lawful and practicable to do so. For example, if you inquire about a particular employment advertisement you do not need to provide your personal details.

YOUR SENSITIVE INFORMATION
Without your consent we will not collect information about you that reveals your racial or ethnic origin, political opinions, religious or philosophical beliefs or affiliations, membership of a professional or trade association, membership of a trade union, details of health, disability, sexual orientation, or criminal record.
This is subject to some exceptions including:
the collection is required by law; or
when the information is necessary for the establishment, exercise or defence of a legal claim.

RESOLVING YOUR PRIVACY ISSUES
If you have any issues you wish to raise with SMCpeople, or would like to discuss any issues about this Policy, then you are able to do so a number of ways. You are welcome to speak directly to us and we will do their best to resolve your issue. If investigation is required we will keep you advised of progress.
Should you feel as if SMCpeople has in any way mishandled your personal information or you are unable to resolve a dispute with us, you are able to contact the Office of Australian Information Commissioner.
